1. Conclusion of the agreement

1.1
The accommodation contract shall be concluded as soon as rooms, premises and other services have been confirmed. All reservations will be confirmed in writing by Hotel Heidekönig. If this is no longer possible due to time constraints, the customer will receive a booking number by telephone. Should the reservation confirmation differ from the content of the registration, the content of the reservation confirmation shall become part of the contract, unless the guest objects immediately upon receipt thereof, at the latest upon acceptance of the services.

1.2
The conclusion of the accommodation agreement obliges the contracting parties to fulfil the contract, regardless of the duration of the contract. The concluded agreement can only be terminated for good cause.

1.3
If the customer is not identical with the guest, both are liable for all contractual obligations as joint and several debtors.

2. Arrival and departure

2.1
Unless otherwise agreed in writing, reserved rooms are available to the guest from 3 pm on the day of arrival and must be vacated by 11 am on the day of departure.

2.2
The reservation dates are binding for both contracting parties. Reserved rooms are only available to the service recipient for the agreed period. Any use of the reserved rooms beyond the agreed period requires the consent of the hotel. In case of a planned departure after 11.00 o'clock, the reception has to be informed at the latest 21.00 o'clock the evening before.

3. Services

3.1
The guest does not acquire any claim to the provision of specific rooms or premises. If agreed premises are not available, the hotel is obliged to make every effort to find an equivalent substitute on the premises or in other properties. The contractual scope of service of the hotel results from the agreements made in writing.

3.2
If rooms or other services are reserved on an option basis, the option dates are binding on both parties. After the expiry of the agreed option period, the hotel may freely dispose of the option-booked rooms and services without consultation.

3.3
Unless otherwise agreed in writing, the prices are per room and night, including VAT. Any increase in value-added tax after the conclusion of the contract shall be borne by the service recipient. Agreed prices can be changed by Hotel Heidekönig after the conclusion of the agreement according to the then valid prices without prior notice if there are more than 6 months between the conclusion of the contract and provision of the service. Any special conditions granted must be agreed on directly at the time of booking or on arrival. Later changes or reductions shall not be possible.

4. Payment

4.1
The payment for the booked services is generally due before the departure of the guest. Hotel Heidekönig is entitled to demand advance payments in the amount of the total expected accommodation price at any time after the conclusion of the accommodation agreement. The Hotel may, without justification, make any order, reservations or other services to be performed conditional upon the payment in advance, in whole or in part, of amounts expected to be owed, in the form of down payments, payments on account or in the case of total payments in advance.
Hotel Heidekönig may request a valid credit card number from a credit card company accepted by Hotel Heidekönig in order to guarantee a reservation and for the resulting services.

4.2
If the invoice amount exceeds 3 times the accommodation price, Hotel Heidekönig is entitled to issue individual interim invoices, e.g. in the form of weekly invoices, and to demand payment from the guest.

4.3
Interim invoices are payable by the guest immediately upon receipt. If the guest defaults on payment, the hotel may cancel the agreement with immediate effect. Hotel Heidekönig reserves the right to claim further costs, in particular the loss of other rentals. Invoices to companies, travel agencies, etc. will only be issued if the invoice recipient submits to the hotel a written declaration of acceptance of costs on their official business paper, and this is accepted by the hotel. Such invoices are payable within fourteen days of the invoice date, without deduction, and in the currency shown on the invoice. The registered office of the hotel shall be regarded as the place of performance for all payment obligations of the guest. This also applies if the guest has been credited for the payment.

4.4
The acceptance and selection of credit cards are at the discretion of Hotel Heidekönig in each individual case, even if the basic acceptance of credit cards is indicated by notices in the hotel. The acceptance of cheques, credit cards, and other means of payment shall only take place on account of performance.

4.5
Prices for groups are only valid on the basis of separate written agreements. Otherwise, the respective valid group price lists of Hotel Heidekönig shall be decisive. The effectiveness of any reservation for groups is, moreover, subject to the payment of a deposit equal to 80% of the services to be reserved, which must be received four weeks before the arrival of the group Hotel Heidekönig for the reservation to become definitive. In the case of group reservations, the hotel reserves the right to reduce the contingent of unused rooms and/or to change the agreed price if less than 75% of the agreed rooms are used.

5. Cancellation policies

5.1
Cancellations of individual bookings are free of charge until 6 pm on the day of arrival.

5.2
In case of changes or cancellations of reserved hotel rooms, function rooms and arrangements for groups (10 persons or more) will be charged:
a) Up to 6 weeks before arrival, no costs.
b) Up to 3 weeks before arrival, 50% of all agreed services.
c) Less than 3 weeks before arrival, 80% of all agreed services.

5.3
Events
The following cancellation deadlines apply to agreed events and the provision of premises:
a) Over 30 days: Calculation of the provision costs is not applicable,
b) From 29th until the day of arrival: provision costs

5.4
If other conditions are formulated on the reservation confirmation, these shall be decisive as long as no objection has been made.

5.5
In trade fair periods, modified cancellation conditions apply, which you can find in our offers or confirmations. If no deviating cancellation conditions are specified, the following conditions apply:
a) Up to 6 months before arrival, no costs.
b) Up to 1 month before arrival, 50% of all agreed services.
c) If less than 1 month before arrival, 90% of all agreed services.

5.6
The hotel can agree to individual cancellations of booked rooms at any time free of charge.

5.7
Cancelled contingents are available to the hotel for renting them to other customers and are no longer reserved for the cancelling customer, even if the customer has made or is obliged to make partial or full payment.

6. Liability

6.1
The guest or the organizer is liable to Hotel Heidekönig for any damage caused by him or her or their guests.

6.2
Hotel Heidekönig is not liable to the guest or the contractual partner if the provision of services becomes impossible in the event of a strike or as a result of force majeure. In such cases, Hotel Heidekönig shall endeavour to procure equivalent services elsewhere.

6.3
Hotel Heidekönig is liable to the guest according to the provisions of the German Civil Code (BGB) (up to 100 times the room rate, a maximum of 3,000 €); for money and valuables according to Sec. 702 BGB, however, only up to 750 €, unless Hotel Heidekönig or its vicarious agents acted with intent or negligence, or the valuables or money were given to Hotel Heidekönig for safekeeping in return for a receipt.

6.4
If the guest brings a vehicle and if this is parked in the parking lot of the Hotel Heidekönig, the liability of the Hotel Heidekönig regarding the vehicle is limited to the liability insurance policies concluded for this purpose, unless Hotel Heidekönig or its vicarious agents acted with intent or gross negligence.

6.5
In the case of organized events, it is the responsibility of the service recipient to insure items brought along against theft or damage, or destruction. Hotel Heidekönig is liable with regard to the loss of or damage to items brought along only for intentional or grossly negligent conduct on the part of Hotel Heidekönig and its vicarious agents.

7. Termination

7.1
If the guest uses the rooms provided to him for a purpose other than that agreed upon, the Hotel Heidekönig is entitled to an extraordinary right of termination. Political events shall be explicitly labelled as such at the time of registration. If Hotel Heidekönig has reasons to believe that an event will jeopardize the smooth operation of the business, the safety or reputation of the hotel or its guests, as well as in the event of force majeure or civil unrest, Hotel Heidekönig may also terminate the contractual relationship without notice.

7.2
The same applies if an organizer advertises in a daily newspaper without the consent of Hotel Heidekönig, which serves as an invitation to job interviews or sales events. In these cases, the hotel is entitled to the agreed remuneration even in the event of termination.

8. Animals

8.1
If agreed upon, pets can be accommodated in the hotel rooms at the Hotel Heidekönig. In case the damage is caused by animals in the room, the guest shall liable for the damage caused.
